1. Introduction

Welcome to Overpacked! These Terms and Conditions ("Terms") govern your use of the Overpacked mobile application and website (collectively, the "Service") operated by Overpacked ("we," "us," or "our"). By accessing or using our Service, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use our Service. We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Acceptance of Terms

By creating an account or using Overpacked, you confirm that you are at least 18 years of age or have the consent of a parent or guardian. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

3. Service Description

Overpacked is a platform that connects travelers who have excess luggage space with individuals who need items transported. The Service allows users to:

• List available luggage space and travel itineraries
• Browse and request item transportation services
• Communicate with other users through our platform
• Rate and review other users
• Process payments for transportation services

Overpacked acts as an intermediary platform and is not responsible for the actual transportation of items or the conduct of users.

OVERPACKED PROVIDES THE SERVICE ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SERVICE, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

To the maximum extent permitted by law, Overpacked shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill arising from:

• Your use or inability to use the Service
• Lost, damaged, or stolen items
• Actions or conduct of other users
• Unauthorized access to your account or data
• Customs seizures or legal issues related to transported items

Our total liability to you for all claims arising from your use of the Service shall not exceed the amount you paid to Overpacked in the twelve (12) months preceding the claim, or $100, whichever is greater.

6. Payment Terms

Payments for transportation services are processed through our secure payment platform. By using the Service, you agree to:

• Pay all fees associated with your use of the Service
• Provide accurate payment information
• Our service fee structure as posted on the platform
• Our refund and cancellation policies

Overpacked reserves the right to change fees at any time with reasonable notice to users.

7. Dispute Resolution

In the event of a dispute between users, we encourage parties to resolve the issue directly. Overpacked may provide mediation assistance but is not obligated to intervene in user disputes.

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, rather than in court, except that you may assert claims in small claims court if your claims qualify.

8. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to:

• Violation of these Terms
• Fraudulent or illegal activity
• Behavior that harms other users or our reputation
• Extended periods of inactivity

You may terminate your account at any time by contacting our support team. Upon termination, your right to use the Service will immediately cease.

9. Intellectual Property

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, icons, images, and software, are the exclusive property of Overpacked and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

10. Indemnification

You agree to indemnify, defend, and hold harmless Overpacked, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
