This data is used exclusively for content moderation, safety enforcement, and platform protection purposes.

f. Account and Authentication Data:

Login credentials, authentication tokens, account activity logs, and security-related information.

g. Technical Data:

Device identifiers, operating system, app version, crash reports, error logs, and system diagnostics.

h. Administrative Access:

Authorized administrators may access all categories of information listed above for moderation, safety enforcement, and platform protection purposes. This access is strictly limited to authorized personnel and is used exclusively for legitimate moderation and safety purposes. By using the platform, you acknowledge and consent to this administrative access.

2. How We Use Your Information

We use your information to:

  • Create and manage accounts, authenticate users, and verify identity
  • Enable marketplace functionality (listings, messaging, transactions)
  • Provide customer support and respond to inquiries
  • Improve app functionality, performance, and user experience
  • Ensure platform safety, security, and prevent fraud
  • Enforce Terms of Service and community guidelines
  • Moderate content, review reports, and take enforcement actions
  • Investigate violations, disputes, and suspicious activity
  • Comply with legal obligations and respond to legal requests
  • Protect our rights, property, and the safety of users
  • Conduct analytics, research, and business operations
  • Send service-related communications and updates
  • Admin Management: Authorized administrators use user data to manage the platform, including viewing all accounts, listings, and messages for moderation purposes, deleting content or accounts that violate our Terms, and maintaining platform safety and integrity

We do NOT sell your personal information to third parties.

REPORTS AND MODERATION:

Report data is used exclusively for:

  • Reviewing and investigating reported content or behavior
  • Making moderation decisions and taking enforcement actions
  • Maintaining platform safety and preventing abuse
  • Protecting users from harmful content or conduct
  • Complying with legal obligations and law enforcement requests
  • Improving moderation systems and processes

Report data may be shared with authorized administrators, moderators, and legal authorities when necessary for enforcement, safety, or legal compliance.

3. Payment Information and Subscription Data

MARKETPLACE TRANSACTIONS:

Overpacked does NOT collect, store, or process payment information for marketplace transactions between buyers and sellers.

All payments for items listed on Overpacked are arranged directly between users off-platform through methods they choose (cash, Venmo, Zelle, PayPal, bank transfer, etc.).

Overpacked has no access to, visibility into, or responsibility for payment transactions between users.

SUBSCRIPTION PAYMENTS (Overpacked Pro):

For optional Overpacked Pro subscriptions:

  • Payment processing is handled entirely by Apple (App Store) or Google (Play Store)
  • Overpacked does NOT have access to your payment card details, billing addresses, or full payment information
  • We only receive confirmation of subscription status and billing period from Apple/Google
  • All subscription billing, refunds, and payment disputes are handled by Apple or Google
  • Overpacked cannot issue refunds or process subscription payments directly

You must contact Apple or Google for any subscription billing issues, refund requests, or payment disputes.

4. Sharing of Information

We may share information with:

• Service Providers:

Third-party vendors who perform services on our behalf (hosting, analytics, customer support, payment processing through Apple/Google). These providers are contractually obligated to protect your information.

• Analytics Partners:

To understand usage patterns and improve our services. Data is typically aggregated and anonymized.

• Law Enforcement and Legal Authorities:

When required by law, court order, subpoena, or to respond to legal process. We may also share information to protect rights, property, safety, or to investigate violations.

• Other Users:

Based on information you choose to share publicly in your profile, listings, or messages.

• Business Transfers:

In the event of a merger, acquisition, or sale of assets, your information may be transferred to the acquiring entity.

• With Your Consent:

When you explicitly authorize us to share your information.

• For Safety and Enforcement:

We may share report data, violation records, and account information with authorized administrators, moderators, and legal authorities to enforce our Terms, protect users, and ensure platform safety. Authorized administrators have access to all user data (including profiles, listings, messages, and reports) solely for moderation, safety enforcement, and platform protection purposes. This access is strictly limited to authorized personnel and is used exclusively for legitimate moderation and safety purposes. By using the platform, you acknowledge and consent to this administrative access.

We do NOT sell, rent, or trade your personal information to third parties for their marketing purposes.

5. Data Retention and Account Deletion

DATA RETENTION:

We retain your personal information as long as your account is active and for a reasonable period thereafter to comply with legal obligations, resolve disputes, enforce agreements, prevent fraud, and maintain platform safety.

REPORT DATA RETENTION:

Report data and moderation records may be retained for extended periods, even after account deletion, for:

  • Legal compliance and regulatory requirements
  • Fraud prevention and security purposes
  • Dispute resolution and legal proceedings
  • Platform safety and abuse prevention
  • Historical record-keeping for enforcement actions

Report data may be retained indefinitely if required by law or necessary for safety and enforcement purposes.

ACCOUNT DELETION:

When you delete your account (via app settings or by contacting [email protected]), the following data is PERMANENTLY deleted:

  • Profile information (name, email, bio, avatar)
  • Login credentials and authentication data
  • All your listings (including photos, descriptions, prices)
  • All uploaded content and media
  • All messages and communications
  • Subscription information (subscription is canceled)
  • User preferences and settings

DATA THAT MAY BE RETAINED:

Some data may be retained in anonymized, aggregated, or identifiable form for:

  • Fraud prevention and security purposes
  • Legal compliance and regulatory requirements
  • Platform analytics and improvement (may be anonymized)
  • Dispute resolution (if required by law)
  • Report data and moderation records (as described above)
  • Transaction records and financial data (as required by law)
  • Backup systems (may take up to 90 days to fully purge)

IRREVERSIBILITY:

Account deletion is permanent and cannot be undone. Once deleted, you cannot recover your data, listings, or account. You are responsible for backing up any information you wish to keep before deletion. Deletion does not affect data that we are legally required to retain or data necessary for safety and enforcement.

SUBSCRIPTION CANCELLATION:

If you have an active Overpacked Pro subscription, it will be automatically canceled upon account deletion. No refunds will be issued for the remaining subscription period. Subscription cancellation is handled through Apple or Google, not Overpacked.

DELETION PROCESS:

Account deletion is processed immediately upon confirmation. Some data may take up to 90 days to be fully removed from all systems, backups, and archives. Data required for legal compliance, safety, or enforcement may be retained indefinitely.

6. Security

We use administrative and technical safeguards. However, no system is completely secure, and Overpacked cannot guarantee absolute protection.

7. Minors

Overpacked is not intended for individuals under 18.

8. Your Rights and Choices

YOUR RIGHTS:

Depending on your location, you may have certain rights regarding your personal information. However, these rights are subject to significant limitations as described below.

  • Access: You may request a copy of your personal data, subject to verification and applicable limitations.
  • Correction: You may request correction of inaccurate personal data in your account profile.
  • Deletion: You may delete your account and request deletion of associated data (see Section 5 for limitations).
  • Restriction: Rights to restrict processing are limited by our need to maintain platform safety and comply with legal obligations.
  • Portability: Data portability rights apply only to data you have provided and may exclude data necessary for platform operation.
  • Objection: You may object to certain processing, but we may continue processing if we have legitimate interests or legal obligations.
  • Withdrawal of Consent: You may withdraw consent, but this may limit your ability to use the platform.

HOW TO EXERCISE YOUR RIGHTS:

  • Account Deletion: Delete your account directly in the app (Settings > Delete Account) or contact [email protected]
  • Data Requests: Contact [email protected] with your request. We reserve the right to charge reasonable fees for excessive or repetitive requests.
  • Subscription Management: Manage subscriptions through Apple or Google settings

We will respond to your request within 30-90 days, subject to verification of your identity and complexity of the request.

SIGNIFICANT LIMITATIONS ON YOUR RIGHTS:

Your rights are significantly limited and may not apply to:

  • Data we are legally required to retain (tax records, transaction history, legal compliance data)
  • Data necessary for fraud prevention, security, and safety enforcement
  • Report data and moderation records (retained for safety and legal purposes)
  • Data necessary to enforce our Terms of Service and prevent abuse
  • Data in backup systems (may take up to 90 days to purge)
  • Anonymized or aggregated data
  • Data necessary for platform operation and service delivery
  • Data subject to ongoing legal proceedings or investigations
  • Data that would compromise other users' privacy or safety

We reserve the right to:

  • Deny requests that are manifestly unfounded, excessive, or repetitive
  • Charge reasonable fees for excessive requests
  • Refuse requests that would compromise platform safety or legal compliance
  • Retain data necessary for our legitimate business interests, legal obligations, or safety purposes
  • Limit or deny requests that would interfere with our ability to provide services or enforce our Terms

By using the platform, you acknowledge and agree to these limitations on your data rights.
